California HCD Review of 9814 Washington Boulevard Disposition

2022-09-21 2001-2022 HCD determination issued September 21, 2022; Culver City later reported that escrow/property transfer was completed in December 2022
At a glance

California Department of Housing and Community Development review of Culver City's proposed disposition of 9814 Washington Boulevard. HCD found the property qualified for the Surplus Land Act grandfathering exemption under Government Code section 54234(b)(1), provided disposition to Rethink Culver was completed by December 31, 2022. The letter also documents a longer redevelopment chain: a 2001 disposition and development agreement with Center Theatre Group, a 2012 City agreement with Jazz Bakery Performance Center, a 2020 exclusive negotiating agreement with Center Theatre Group, and 2022 assignments from Center Theatre Group to REthink Development Corp. and then to Rethink Culver, LLC.

Context note

HCD's letter uses the spelling 'Center Theater Group'; the organization's current official name and spelling is Center Theatre Group. HCD also states that Culver City's Long Range Property Management Plan erroneously referred to the January 31, 2012 Jazz Bakery Performance Center agreement as a 2010 agreement. Those source-specific discrepancies are preserved. The assignment language establishes transfer of documented contractual rights, title, interests and related obligations under the ENA chain; it is not treated as proof that Center Theatre Group held fee title to the parcel. HCD's September 2022 conclusion was conditional on disposition being completed by December 31, 2022; current City materials state escrow was completed in December 2022.
